1. Description of Service

Pancake is a personal finance and budgeting application that helps you track spending, manage budgets, and gain insights into your financial habits. The Service includes:

Bank Account Connectivity: Connection to your financial accounts through Plaid, Inc. ("Plaid") to retrieve transaction and balance data
Budget Management: Tools to create, track, and manage spending budgets
Transaction Tracking: Automatic categorization and organization of your financial transactions
AI-Powered Insights: Personalized analysis and suggestions based on your spending patterns (available with certain subscription tiers)
Financial Goals: Tools to set and track savings and financial goals

IMPORTANT DISCLAIMER: Pancake is an informational tool only. The Service does not provide financial, investment, tax, legal, or accounting advice. Any insights, suggestions, or recommendations provided by Pancake, including AI-generated content, are for informational purposes only and should not be relied upon as professional financial advice. Always consult with qualified professionals before making financial decisions.

2. Eligibility

To use the Service, you must:

Be at least 18 years of age
Be a legal resident of the United States
Have the legal capacity to enter into a binding agreement
Provide accurate and complete registration information
Not have been previously suspended or removed from the Service

3. Account Registration and Security

3.1 Account Creation

To access the Service, you must create an account by providing a valid email address and creating a password. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Immediately notifying us at support@pancakemoney.com if you suspect unauthorized access

We strongly recommend enabling multi-factor authentication (MFA) for enhanced account security.

3.3 One Account Per Person

Each user may maintain only one account. Creating multiple accounts may result in termination of all accounts.

4. Plaid Integration

4.1 Third-Party Service

The Service uses Plaid to connect to your financial institutions. By using Pancake, you acknowledge and agree that:

You are also bound by Plaid's End User Privacy Policy
Plaid will access your financial account credentials and data on your behalf
We do not store your bank login credentials; they are handled securely by Plaid
Connection availability depends on Plaid's support for your financial institution

4.2 Data Accuracy

While we strive to display accurate financial data, we rely on information provided by Plaid and your financial institutions. We are not responsible for inaccuracies, delays, or errors in data provided by third parties.

4.3 Disconnecting Accounts

You may disconnect your linked financial accounts at any time through the app settings.

5. Subscription and Payment Terms

5.1 Free and Paid Tiers

Pancake offers both free and paid subscription tiers. Certain features, including advanced AI insights, may only be available to paid subscribers.

5.2 Billing

If you subscribe to a paid tier:

You authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your selection)
Subscription fees are billed in advance at the beginning of each billing period
All fees are quoted and charged in U.S. dollars

5.3 Cancellation

You may cancel your subscription at any time through the app or by contacting support@pancakemoney.com. Upon cancellation:

Your subscription will remain active until the end of the current billing period
You will not receive a refund for any unused portion of the billing period
Your account will revert to the free tier

5.4 Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of your next billing period following notice to you.

5.5 App Store Subscriptions and Refunds

If you subscribed to the Service through a third-party app store (e.g., Apple App Store or Google Play Store), the following terms apply:

Billing: Your payment method will be charged by the applicable App Store, not by Pancake directly.
Management: You must manage your subscription (cancellations, tier changes) through your App Store account settings.
Refunds: All refund requests must be submitted directly to the applicable App Store. Pancake does not have the ability to process refunds for purchases made through third-party App Stores, and such transactions are subject to the App Store's own refund policies.

6. User Conduct

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Provide false, misleading, or inaccurate information
Attempt to gain unauthorized access to the Service, other accounts, or our systems
Interfere with or disrupt the Service or servers
Reverse engineer, decompile, or disassemble any part of the Service
Use automated means (bots, scrapers, etc.) to access the Service without permission
Transmit viruses, malware, or other harmful code
Violate the intellectual property rights of Pancake or third parties
Use the Service to commit fraud or other illegal financial activities

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, content, and underlying technology, is owned by Pancake Money LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

7.2 Your Content

You retain ownership of any personal data you provide. By using the Service, you grant us a license to use, process, and store your data as necessary to provide the Service.

7.3 Feedback

If you provide suggestions, feedback, or ideas about the Service, you grant us the right to use such feedback without compensation or attribution.

8. AI Insights and Disclaimers

8.1 No Fiduciary Duty

You agree that Pancake is not acting as your fiduciary, investment advisor, or financial planner. Your use of the Service does not create a fiduciary relationship between you and Pancake.

8.2 Artificial Intelligence Disclaimer

The Service utilizes artificial intelligence ("AI") to generate text, budgets, and insights. You acknowledge that:

AI may produce inaccurate, inconsistent, or "hallucinated" information.
You should strictly verify all AI-generated figures against your official bank statements before making financial decisions.
Non-Reliance: You agree not to execute any trade, investment, or major financial decision solely based on AI-generated suggestions from the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
UNINTERRUPTED OR ERROR-FREE OPERATION
SECURITY OF DATA TRANSMISSIONS

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

PANCAKE MONEY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100

THIS LIMITATION APPLIES TO ALL CLAIMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pancake Money LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any content you submit or transmit through the Service

12. Termination

12.1 By You

You may terminate your account at any time by deleting your account through the app settings or by contacting support@pancakemoney.com.

12.2 By Us

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include:

Violation of these Terms
Fraudulent or illegal activity
Extended periods of inactivity
Request by law enforcement

12.3 Effect of Termination

Upon termination:

Your right to use the Service ceases immediately
We may delete your account data, subject to our Privacy Policy
Provisions that by their nature should survive (including limitations of liability, indemnification, and dispute resolution) will remain in effect

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@pancakemoney.com to attempt to resolve the matter informally. Most disputes can be resolved this way.

13.2 Binding Arbitration

If we cannot resolve a dispute informally within 60 days, you and Pancake agree to resolve any claims through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in the State of California.

13.3 Class Action Waiver

YOU AND PANCAKE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

13.4 Exceptions

The following disputes are not subject to arbitration:

Claims that may be brought in small claims court
Disputes concerning intellectual property rights

13.5 Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.

14. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by:

Posting the updated Terms in the app
Sending a notification to your registered email address

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pancake regarding the Service.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.

15.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.
